{"id":13565,"date":"2019-09-05T09:12:57","date_gmt":"2019-09-05T13:12:57","guid":{"rendered":"https:\/\/staging.schneiderlegal.com\/?p=13565"},"modified":"2019-09-05T09:12:57","modified_gmt":"2019-09-05T13:12:57","slug":"5-choses-a-savoir-sur-les-servitudes-les-enclaves-et-les-droits-de-passages","status":"publish","type":"post","link":"https:\/\/staging.schneiderlegal.com\/fr\/2019\/09\/05\/5-choses-a-savoir-sur-les-servitudes-les-enclaves-et-les-droits-de-passages\/","title":{"rendered":"5 choses \u00e0 savoir sur les servitudes, les enclaves et les droits de passages"},"content":{"rendered":"[vc_row][vc_column][vc_column_text]Lorsqu\u2019un lot n\u00e9cessite une servitude ou un passage sur un lot voisin, il y a cinq (5) choses \u00e0 retenir\u00a0:<\/p>\n<ol>\n<li><strong><u> Servitude R\u00e9elle (1177ss C.c.Q.) :<\/u><\/strong><\/li>\n<\/ol>\n<ul>\n<li>Une servitude r\u00e9elle est un droit d\u2019usage en faveur d\u2019un lot (fonds dominant) sur un lot servant (fonds servant).<\/li>\n<li>La servitude r\u00e9elle lie les deux lots et non les propri\u00e9taires de ceux-ci.<\/li>\n<li>Si elle est publi\u00e9e au registre foncier, ind\u00e9pendamment des propri\u00e9taires qui seraient nouveaux acqu\u00e9reurs de l\u2019un ou l\u2019autre des lots elle leur sera opposable.<\/li>\n<\/ul>\n<ol start=\"2\">\n<li><strong><u> Comment s\u2019\u00e9tablit la servitude r\u00e9elle et qu\u2019est-ce qu\u2019elle inclut?<\/u><\/strong><\/li>\n<\/ol>\n<ul>\n<li>Selon l\u2019article 1181 du <em>Code civil du Qu\u00e9bec,<\/em> \u2039\u2039la servitude s\u2019\u00e9tablit par contrat, par testament, par destination du propri\u00e9taire ou par l\u2019effet de la loi \u203a\u203a.<\/li>\n<li>Elle sera g\u00e9n\u00e9ralement conclue par contrat entre le propri\u00e9taire du fonds servant et celui du fonds dominant. Elle inclut l\u2019assiette de la servitude, c\u2019est-\u00e0-dire l\u2019espace physique que repr\u00e9sente la servitude.<\/li>\n<li>Il pourra \u00e9galement \u00eatre inclut \u00e0 l\u2019acte constitutif de la servitude, les conditions d\u2019utilisations et d\u2019entretiens de celle-ci. Cependant, dans le cas o\u00f9 certains \u00e9l\u00e9ments seraient manquants, \u2039\u2039la servitude s\u2019\u00e9tend \u00e0 tout ce qui est n\u00e9cessaire \u00e0 son exercice \u203a\u203a<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a>.<\/li>\n<li>Il est important de mentionner que l\u2019usage d\u2019un chemin par tol\u00e9rance, et ce m\u00eame pendant une longue p\u00e9riode, ne constitue pas une servitude.<\/li>\n<\/ul>\n<p>Pour plus d\u2019information sur les servitudes, veuillez consulter\u00a0: <a href=\"https:\/\/staging.schneiderlegal.com\/fr\/droit-immobilier\/troubles-de-voisinage\/\">https:\/\/staging.schneiderlegal.com\/fr\/droit-immobilier\/troubles-de-voisinage\/<\/a><\/p>\n<ol start=\"3\">\n<li><strong><u> Droit de passage pour lot enclav\u00e9 :<\/u><\/strong><\/li>\n<\/ol>\n<ul>\n<li>Un lot enclav\u00e9 peut \u00eatre d\u00e9finie par le fait \u2039\u2039 qu\u2019il n\u2019ait aucune issue sur la voie publique, soit que l\u2019issue soit insuffisante, difficile ou impraticable \u203a\u203a<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a>.<\/li>\n<li>Dans le cas o\u00f9 le fonds servant n\u2019accepte pas de fournir une servitude au fonds dominant, ce dernier pourra en faire la demande au tribunal afin de se faire accorder un droit de passage.<\/li>\n<li>La demande d\u2019un droit de passage est une solution ult\u00e9rieure \u00e0 la servitude contractuelle qui devrait \u00eatre envisag\u00e9e seulement lorsqu\u2019une entente \u00e0 l\u2019amiable semble peu probable.<\/li>\n<\/ul>\n<ol start=\"4\">\n<li><strong><u> Extinctions des servitudes r\u00e9elles : <\/u><\/strong><\/li>\n<\/ol>\n<ul>\n<li>Les principales raisons de l\u2019extinction d\u2019une servitude r\u00e9elle sont les suivantes<a href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a>:<\/li>\n<li>Par la r\u00e9union dans une m\u00eame personne de la qualit\u00e9 de propri\u00e9taire des fonds servant et dominant;<\/li>\n<li>Par la renonciation expresse du propri\u00e9taire du fonds dominant;<\/li>\n<li>Par l\u2019arriv\u00e9e du terme pour lequel elle a \u00e9t\u00e9 constitu\u00e9e;<\/li>\n<li>Par le rachat;<\/li>\n<li>Par le non-usage pendant 10 ans<\/li>\n<\/ul>\n<ol start=\"5\">\n<li><strong><u> Distinction entre servitude personnelle et r\u00e9elle :<\/u><\/strong><\/li>\n<\/ol>\n<ul>\n<li>Contrairement \u00e0 une servitude r\u00e9elle, qui affecte deux (2) fonds, la servitude personnelle affecte un individu physique et un fonds.<\/li>\n<li>Elle conf\u00e8re un droit r\u00e9el \u00e0 l\u2019individu physique sur le fonds servant. Un exemple de servitude personnelle est l\u2019usufruit. L\u2019usufruit permet \u00e0 l\u2019usufruitier d\u2019user et de jouir du fonds servant.<\/li>\n<li>\u00c0 l\u2019oppos\u00e9 de la servitude r\u00e9elle qui n\u2019est pas limit\u00e9e dans le temps, la servitude personnelle est limit\u00e9e dans le temps.
