{"id":13469,"date":"2019-08-06T10:24:36","date_gmt":"2019-08-06T14:24:36","guid":{"rendered":"https:\/\/staging.schneiderlegal.com\/fr\/?p=13469"},"modified":"2019-08-06T10:24:36","modified_gmt":"2019-08-06T14:24:36","slug":"5-choses-a-savoir-pour-un-locateur-commercial-concernant-labandon-des-lieux-par-le-locataire","status":"publish","type":"post","link":"https:\/\/staging.schneiderlegal.com\/fr\/2019\/08\/06\/5-choses-a-savoir-pour-un-locateur-commercial-concernant-labandon-des-lieux-par-le-locataire\/","title":{"rendered":"5 choses \u00e0 savoir pour un locateur commercial concernant l\u2019abandon des lieux par le locataire"},"content":{"rendered":"[vc_row][vc_column][vc_column_text]Lors de l\u2019abandon des lieux par un locataire commercial, cinq choses sont importantes \u00e0 savoir pour le locateur.<\/p>\n<ol>\n<li><strong><u> R\u00e9clamer la remise en \u00e9tat des lieux (1890-1891 C.c.Q.) :<\/u><\/strong><\/li>\n<\/ol>\n<ul>\n<li>Le locateur est en droit de demander que le locataire remettre les lieux dans le m\u00eame \u00e9tat qu\u2019il les a re\u00e7us ainsi que l\u2019enl\u00e8vement des ouvrages, constructions ou plantations faits par le locataire.<\/li>\n<li>Advenant que le locataire ne remettre pas les lieux dans le m\u00eame \u00e9tat qu\u2019il les a re\u00e7us, le locateur est en droit de r\u00e9clamer les frais encourus, le cas \u00e9ch\u00e9ant, pour la remise en \u00e9tat des lieux.<\/li>\n<li>Le locataire n\u2019est cependant pas responsable des changements r\u00e9sultant de la v\u00e9tust\u00e9, de l\u2019usure normale ou d\u2019une force majeure.<\/li>\n<\/ul>\n<ol start=\"2\">\n<li><strong><u> Minimiser ses dommages (1479 C.c.Q.):<\/u><\/strong><\/li>\n<\/ol>\n<ul>\n<li>Le locateur doit mitiger ses dommages par la mise en location des lieux. Le fardeau de preuve \u00e9tant sur le locateur, il devra faire la preuve qu\u2019il a pris les moyens n\u00e9cessaires pour relouer les lieux \u00e0 un nouveau locataire.<\/li>\n<li>Les \u00e9l\u00e9ments importants pouvant en faire preuve sont notamment la publicit\u00e9 de cette mise en location ; affiches, annonces papiers et\/ou \u00e9lectroniques, factures de publicit\u00e9 encourues, embauche d\u2019un courtier immobilier, registre des locataires potentiels ayant visit\u00e9 les lieux, etc.<\/li>\n<li>Le locateur doit tenter d\u2019avoir le meilleur loyer possible pour la relocation des lieux selon le principe de la bonne foi (6-7-1375 C.c.Q). Ceci aura une incidence sur la demande future de compensations raisonnables et appropri\u00e9es.<\/li>\n<\/ul>\n<ol start=\"3\">\n<li><strong><u> R\u00e9clamer le remboursement des frais et honoraires extrajudiciaires:<\/u><\/strong><\/li>\n<\/ol>\n<ul>\n<li>Dans l\u2019affaire <em>Van Houtte<a href=\"#_ftn1\" name=\"_ftnref1\"><strong>[1]<\/strong><\/a>, <\/em>la Cour d\u2019appel du Qu\u00e9bec a confirm\u00e9 que le locateur peut r\u00e9clamer le remboursement des frais et honoraires extrajudiciaires encourus pour le manquement du locataire \u00e0 son obligation d\u2019occuper les lieux<\/li>\n<li>Il faut cependant noter que dans l\u2019affaire <em>Van Houtte, <\/em>le bail liant le locateur et le locataire pr\u00e9voyait une clause \u00e0 l\u2019effet que le locataire paiera au locateur tous les co\u00fbts, d\u00e9penses et frais juridiques que le locateur devra encourir pour faire respecter l\u2019ex\u00e9cution des dispositions, conditions et obligations du bail.<\/li>\n<li>Il est donc sugg\u00e9r\u00e9 de pr\u00e9voir une clause dans le bail \u00e0 l\u2019effet que le locataire aura la charge enti\u00e8re et compl\u00e8te des frais, d\u00e9penses et honoraires d\u2019avocats raisonnablement encourus ou pay\u00e9s par le locateur dans l\u2019\u00e9ventualit\u00e9 o\u00f9 ce dernier doit recourir aux services d\u2019avocat et\/ou entreprendre des proc\u00e9dures judiciaires contre le locataire par suite d\u2019un d\u00e9faut de respecter l\u2019une ou l\u2019autre de ses obligations stipul\u00e9es dans le bail.<\/li>\n<\/ul>\n<ol start=\"4\">\n<li><strong><u> R\u00e9clamer la perte de loyers futurs et autres dommages-int\u00e9r\u00eats:<\/u><\/strong><\/li>\n<\/ol>\n<ul>\n<li>Le locateur est en droit de demander des dommages et int\u00e9r\u00eats pour le pr\u00e9judice subi qui est en lien direct et imm\u00e9diat avec l\u2019abandon des lieux du locataire, soit la perte de loyers futurs.<\/li>\n<li>En ce qui concerne la perte de loyers futurs, aussi connue sous l\u2019appellation de \u00ab dommages liquid\u00e9s \u00bb ou \u00ab loyers acc\u00e9l\u00e9r\u00e9s \u00bb, certains baux pr\u00e9voient qu\u2019advenant un d\u00e9faut du locataire tel qu\u2019un abandon des lieux, le plein montant des versements du loyer du mois courant et de la totalit\u00e9 des loyers des six (6) ou douze (12) mois suivants deviennent dus et exigibles. Il s\u2019agit ici d\u2019une clause dite p\u00e9nale.<\/li>\n<li>Cependant, le tribunal peut user de sa discr\u00e9tion pour r\u00e9duire le montant r\u00e9clam\u00e9 par le locateur en guise de \u00ab dommages liquid\u00e9s \u00bb ou \u00ab loyers acc\u00e9l\u00e9r\u00e9s \u00bb en vertu de la clause p\u00e9nale, dans la mesure o\u00f9 le tribunal consid\u00e8re cette derni\u00e8re comme \u00e9tant abusive ou disproportionn\u00e9e au pr\u00e9judice r\u00e9ellement subi par le locateur, ou pour \u00e9viter une double indemnit\u00e9.<\/li>\n<li>En outre, le locateur est en droit de r\u00e9clamer les arr\u00e9rages de loyers, dans la mesure o\u00f9 les loyers ne sont pas prescrits.
