{"id":13445,"date":"2019-07-21T17:55:14","date_gmt":"2019-07-21T21:55:14","guid":{"rendered":"https:\/\/staging.schneiderlegal.com\/fr\/?p=13445"},"modified":"2019-07-21T18:50:32","modified_gmt":"2019-07-21T22:50:32","slug":"5-choses-a-savoir-concernant-laction-en-passation-de-titre","status":"publish","type":"post","link":"https:\/\/staging.schneiderlegal.com\/fr\/2019\/07\/21\/5-choses-a-savoir-concernant-laction-en-passation-de-titre\/","title":{"rendered":"5 choses \u00e0 savoir concernant l\u2019action en passation de titre"},"content":{"rendered":"[vc_row][vc_column][vc_column_text]\n<ol>\n<li><strong><u> Qu\u2019est-ce qu\u2019une action en passation de titre ? <\/u><\/strong><\/li>\n<\/ol>\n<ul>\n<li>En droit qu\u00e9b\u00e9cois, on appelle \u00ab passation de titre \u00bb le transfert qui s\u2019op\u00e8re typiquement lors d\u2019un contrat de vente\u00a0: en \u00e9change d\u2019un certain montant d\u2019argent, le vendeur transf\u00e8re, \u00e0 l\u2019acheteur, le droit de propri\u00e9t\u00e9 qu\u2019il a sur le bien, rendant ainsi cet acheteur propri\u00e9taire de celui-ci.<\/li>\n<\/ul>\n<ol start=\"2\">\n<li><strong><u> Obstacles possible :<\/u><\/strong><\/li>\n<\/ol>\n<ul>\n<li><u>Que se passe-t-il lorsqu&rsquo;un acheteur d\u00e9cide de NE PAS acheter la propri\u00e9t\u00e9 ?<\/u><\/li>\n<li><u>Que se passe-t-il lorsqu&rsquo;un vendeur refuse de transf\u00e9rer le titre de propri\u00e9t\u00e9 \u00e0 l&rsquo;acheteur ?<\/u><\/li>\n<li>Les deux parties ont un droit de recours lorsqu&rsquo;elles se trouvent dans une situation pr\u00e9judiciable.<\/li>\n<li>Pour un exemple de dispute, veuillez visiter\u00a0:<a href=\"https:\/\/staging.schneiderlegal.com\/fr\/2016\/09\/20\/action-en-passation-de-titre\/\">https:\/\/staging.schneiderlegal.com\/fr\/2016\/09\/20\/action-en-passation-de-titre\/<\/a><\/li>\n<\/ul>\n<ol start=\"3\">\n<li><strong><u> Une promesse d&rsquo;achat peut-elle \u00eatre retir\u00e9e ?<\/u><\/strong><\/li>\n<\/ol>\n<ul>\n<li>L&rsquo;OACIQ d\u00e9clare qu&rsquo;une promesse d&rsquo;achat est <strong>irr\u00e9vocable<\/strong> jusqu&rsquo;\u00e0 la date limite qui y est indiqu\u00e9e. En d&rsquo;autres termes, d\u00e8s que le vendeur a la promesse d&rsquo;achat en main, l&rsquo;acheteur ne peut plus la retirer, tant que la promesse d&rsquo;achat est valide.<\/li>\n<li>Toutefois, le C.c.Q. accorde \u00e0 l&rsquo;acheteur une petite fen\u00eatre dans laquelle il peut retirer sa promesse, c&rsquo;est-\u00e0-dire la p\u00e9riode entre le moment o\u00f9 la promesse d&rsquo;achat est sign\u00e9e et le moment o\u00f9 elle parvient au vendeur.<\/li>\n<li>Lorsque le vendeur re\u00e7oit une r\u00e9vocation avant la promesse d&rsquo;achat, la promesse devient caduque (voir C.c.Q., art. 1391).<\/li>\n<\/ul>\n<ol start=\"4\">\n<li><strong><u> Responsabilit\u00e9s du courtier :<\/u><\/strong><\/li>\n<\/ol>\n<ul>\n<li>Un courtier doit:<\/li>\n<\/ul>\n<ol style=\"list-style-type: lower-alpha;\">\n<li>En tout temps, informer l&rsquo;acheteur que sa promesse d&rsquo;achat le lie au vendeur d\u00e8s qu&rsquo;il la signe ;<\/li>\n<li>Si un acheteur informe le vendeur qu&rsquo;il ne d\u00e9sire plus acheter l&rsquo;immeuble ou ne pr\u00e9sente plus la promesse d&rsquo;achat, le courtier doit indiquer \u00e0 l&rsquo;acheteur qu&rsquo;il doit faire parvenir au vendeur, le plus t\u00f4t possible, une r\u00e9vocation de sa promesse d&rsquo;achat, \u00e9tant donn\u00e9 que le courtier est tenu de soumettre toute proposition de transaction qu&rsquo;il re\u00e7oit dans les meilleurs d\u00e9lais ;<\/li>\n<li>Au moment de soumettre la promesse d&rsquo;achat, le courtier doit informer le vendeur de l&rsquo;intention de l&rsquo;acheteur de ne pas proc\u00e9der avec la transaction<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a>.<\/li>\n<\/ol>\n<ul>\n<li>Si un courtier manque \u00e0 ses devoirs et obligations, la partie l\u00e9s\u00e9e doit se r\u00e9server tous les droits et recours contre l&rsquo;agent immobilier.<\/li>\n<\/ul>\n<ol start=\"5\">\n<li><strong><u> Afin de prouver la validit\u00e9 de la passation de titre, les formalit\u00e9s suivantes doivent \u00eatre respect\u00e9es\u00a0:<\/u><\/strong><\/li>\n<\/ol>\n<ol style=\"list-style-type: lower-alpha;\">\n<li>Existence d&rsquo;une promesse valable : juridiquement contraignante entre un acheteur et un vendeur d\u00e8s sa signature.<\/li>\n<li>Lettre de mise en demeure : mettre formellement la partie en d\u00e9faut de respecter ses obligations (vente ou achat).<\/li>\n<li>Projet d\u2019acte de vente conforme \u00e0 la promesse d&rsquo;achat : projet d\u2019acte de vente notari\u00e9 respectant en tout point la promesse d&rsquo;achat. Le projet d\u2019acte de vente notari\u00e9 doit \u00eatre sign\u00e9 par le Demandeur de l\u2019action en passation de titre.<\/li>\n<li>Offres r\u00e9elles et consignation du prix de vente : l&rsquo;acheteur qui veut r\u00e9ussir son action en passation de titre doit d\u00e9montrer sa capacit\u00e9 \u00e0 payer le prix convenu du bien et son intention de conclure la vente.
