Un principe essentiel du droit des biens est la prescription des meubles et immeubles ; elle se divise en deux cat\u00e9gories : la prescription acquisitive et la prescription extinctive.<\/p>\n<p>\u00ab La <strong>prescription extinctive<\/strong> est un moyen d\u2019\u00e9teindre un droit par non-usage ou d\u2019opposer une fin de non-recevoir \u00e0 une action \u00bb selon l\u2019article 2921 C.c.Q. En d\u2019autres mots, cela veut simplement dire qu\u2019une personne peut perdre son droit de poursuite judiciaire si elle exc\u00e8de les d\u00e9lais autoris\u00e9s par la loi.<\/p>\n<p>En ce qui concerne la <strong>prescription acquisitive<\/strong>, on r\u00e9f\u00e8re \u00e0 \u00ab un moyen d\u2019acqu\u00e9rir le droit de propri\u00e9t\u00e9 ou l\u2019un de ses d\u00e9membrements, par l\u2019effet de la possession \u00bb selon l\u2019article 2910 C.c.Q. Afin d\u2019\u00eatre en position de d\u00e9clarer la possession et produire des effets de loi, la nature de ladite possession doit \u00eatre paisible (en l\u2019absence de violence), continue (sans interruption), publique (non clandestin) et non \u00e9quivoque (sans ambigu\u00eft\u00e9) selon l\u2019article 922 C.c.Q.<\/p>\n<p>Ici, la notion de possession exige les conditions cumulatives de (1) la possession mat\u00e9rielle du bien et (2) de l\u2019intention d\u2019en \u00eatre le propri\u00e9taire.<\/p>\n<p>Commun\u00e9ment, lorsqu\u2019un individu affirme sa possession mat\u00e9rielle, son intention de devenir propri\u00e9taire est pr\u00e9sum\u00e9. Quiconque conteste ladite possession en a le fardeau de la preuve et doit prouver l\u2019absence or l\u2019insuffisance des deux conditions cumulatives.<\/p>\n<p>Sous l\u2019aile de la prescription acquisitive, le Code civil du Qu\u00e9bec reconna\u00eet deux d\u00e9lais, une de dix ans pour les biens immeubles, et une de trois ans pour les biens meubles. Ordinairement, s\u2019il n\u2019est autrement fix\u00e9 par la loi, le d\u00e9lai de prescription acquisitive est de 10 ans.<\/p>\n<p>Donc, pour permettre \u00e0 une personne d\u2019acqu\u00e9rir par prescription acquisitive, par exemple, un immeuble de Montr\u00e9al, il lui faudra une possession mat\u00e9rielle et l\u2019intention d\u2019en \u00eatre le propri\u00e9taire pendant 10 ans. Apr\u00e8s une d\u00e9cennie, la loi permet \u00e0 cet individu de faire une demande judiciaire pour acqu\u00e9rir le titre de propri\u00e9taire en vertu de l\u2019article 2918 C.c.Q.<\/p>\n<p><em>\u00ab Celui qui pendant 10 ans, a poss\u00e9d\u00e9 un immeuble \u00e0 titre de propri\u00e9taire ne peut en acqu\u00e9rir la propri\u00e9t\u00e9 qu\u2019\u00e0 la suite d\u2019une demande en justice. \u00bb<\/em><\/p>\n<p>Dans l\u2019affaire Frigon c. Rompr\u00e9, la demanderesse, qui est propri\u00e9taire du lot 372, occupe aussi sans titre une partie du lot voisin. Elle demande de reconna\u00eetre son droit de propri\u00e9t\u00e9 exclusif sur cette parcelle de terrain. Elle occupe le terrain litigieux depuis 1943. Elle y a cultiv\u00e9 un jardin, y a install\u00e9 un garage et, finalement, y a install\u00e9 une piscine. Elle a toujours occup\u00e9 le terrain de fa\u00e7on non \u00e9quivoque, paisible et publique \u00e0 titre de propri\u00e9taire. L\u2019intim\u00e9e n\u2019y a circul\u00e9 que pour entretenir son propre immeuble. L\u2019exercice de son droit de passage n\u2019a pas emp\u00each\u00e9 la demanderesse d\u2019en avoir une possession utile. Celle-ci a donc acquis ce terrain par prescription acquisitive.<\/p>\n<p>R\u00e9cemment, un jugement de la Cour Supr\u00eame <em>Ostiguy <\/em>c. <em>Allie\u00a0<\/em>est venu \u00e9tablir que la possession mat\u00e9rielle d\u2019un bien immeuble en vertu du C.c.Q., art. 922 a pr\u00e9s\u00e9ance sur les titres apparaissant au Registre Foncier du Qu\u00e9bec.<\/p>\n<p>Ostiguy c.
