{"id":11447,"date":"2016-07-29T21:44:56","date_gmt":"2016-07-29T21:44:56","guid":{"rendered":"http:\/\/schneiderlegal.preview.web22.propulsionweb.ca\/fr\/?p=11447"},"modified":"2016-07-30T18:17:47","modified_gmt":"2016-07-30T18:17:47","slug":"nouvelles-regles-en-matiere-successorale","status":"publish","type":"post","link":"https:\/\/staging.schneiderlegal.com\/fr\/2016\/07\/29\/nouvelles-regles-en-matiere-successorale\/","title":{"rendered":"NOUVELLES R\u00c8GLES EN MATI\u00c8RE SUCCESSORALE"},"content":{"rendered":"<p style=\"text-align: justify;\">Avec la r\u00e9forme du <em>Code de proc\u00e9dure civile <\/em>(C.p.c.), le l\u00e9gislateur a sp\u00e9cifiquement adress\u00e9 certaines situations qui existaient ant\u00e9rieurement relativement aux deux \u00e9l\u00e9ments qui suivent\u00a0:<\/p>\n<p style=\"padding-left: 60px; text-align: justify;\"><a href=\"#coffres\">i) Les coffres-forts; et<\/a><\/p>\n<p style=\"padding-left: 60px; text-align: justify;\"><a href=\"#delivrance\">ii) La d\u00e9livrance d\u2019actes notari\u00e9s.<\/a><\/p>\n<p style=\"padding-left: 30px; text-align: justify;\"><span id=\"coffres\">a) Les coffres-forts et la proc\u00e9dure l\u00e9gale devant \u00eatre employ\u00e9e afin d\u2019avoir acc\u00e8s \u00e0 leur contenu<\/span><\/p>\n<p style=\"text-align: justify;\">En vertu du premier ali\u00e9na de l\u2019article 478 C.p.c., dans l\u2019\u00e9ventualit\u00e9 qu\u2019une personne loue un coffre-fort dans un \u00e9tablissement financier et que cette derni\u00e8re d\u00e9c\u00e8de, le liquidateur de la succession pourrait en tout l\u00e9gitimit\u00e9 ouvrir ledit coffre-fort. En l\u2019absence d\u2019un liquidateur, les ayants cause seraient l\u00e9galement autoris\u00e9 \u00e0 ouvrir ce dernier.<\/p>\n<p style=\"text-align: justify;\">Alternativement, le deuxi\u00e8me alin\u00e9a de l\u2019article 478 C.p.c. stipule que toute personne autoris\u00e9e par le tribunal comp\u00e9tent peut \u00e9galement ouvrir un coffre-fort lou\u00e9 dans un tel \u00e9tablissement. N\u00e9anmoins, le tribunal n\u2019accorde l\u2019autorisation que s\u2019il estime que toutes les personnes qui pourraient avoir des droits dans les biens s\u2019y trouvant ont \u00e9t\u00e9 notifi\u00e9es de la demande ou que des efforts suffisants ont \u00e9t\u00e9 faits pour qu\u2019elles le soient. Il faut \u00e9galement noter que le tribunal peut autoriser l\u2019ouverture selon les modalit\u00e9s qu\u2019il d\u00e9termine.<\/p>\n<p style=\"text-align: justify;\">\u00a0Par ailleurs, conform\u00e9ment au troisi\u00e8me alin\u00e9a de cet article, un proc\u00e8s-verbal est dress\u00e9 par un notaire ou un huissier lors de l\u2019ouverture du coffre-fort et mentionne les personnes pr\u00e9sentes, le contenu du coffre-fort et les biens qui en sont retir\u00e9s. En cas de d\u00e9c\u00e8s du locataire, seul le notaire est autoris\u00e9 \u00e0 dresser le proc\u00e8s-verbal.<\/p>\n<p style=\"padding-left: 30px; text-align: justify;\"><span id=\"delivrance\">b) La d\u00e9livrance d\u2019actes notari\u00e9s \u00e0 une partie int\u00e9ress\u00e9e en vertu des articles 484 et 485 C.p.c.<\/span><\/p>\n<p style=\"text-align: justify;\">Selon l\u2019article 866 de l\u2019ancien <em>Code de proc\u00e9dure civile<\/em> (ci-apr\u00e8s d\u00e9sign\u00e9 comme \u00ab\u00a0ancien code\u00a0\u00bb), les notaires n\u2019\u00e9taient tenus \u00e0 donner communication ou \u00e0 d\u00e9livrer des copies des actes ou des extraits d\u2019actes qui font partie de leur greffe, ou des greffes dont ils sont cessionnaires ou gardiens, qu\u2019aux parties \u00e0 l\u2019acte, \u00e0 leurs h\u00e9ritiers ou \u00e0 leurs repr\u00e9sentants.<\/p>\n<p style=\"text-align: justify;\">Toutefois, depuis la r\u00e9forme du 1<sup>er<\/sup> janvier 2016, le premier alin\u00e9a de l\u2019article 484 C.p.c. \u00e9dicte que les notaires sont d\u00e9sormais tenus \u00e0 donner communication et \u00e0 d\u00e9livrer ces actes \u00e0 des personnes qui, en l\u2019absence de testament, auraient eu vocation \u00e0 recevoir la succession, si elles en font la demande.
