Ce d\u00e9lai commence \u00e0 courir, lorsque le vice appara\u00eet graduellement, du jour o\u00f9 l&rsquo;acheteur a pu en soup\u00e7onner la gravit\u00e9 et l&rsquo;\u00e9tendue.<\/em><\/p>\n<p style=\"text-align: justify;\"><em>Le vendeur ne peut se pr\u00e9valoir d&rsquo;une d\u00e9nonciation tardive de l&rsquo;acheteur s&rsquo;il connaissait ou ne pouvait ignorer le vice.<\/em><\/p>\n<p style=\"text-align: justify;\">Pourtant, dans la d\u00e9cision <em>Reulet <\/em>c.<em> Desch\u00eanes<\/em>, la Cour d&rsquo;appel a adopt\u00e9 une interpr\u00e9tation plus large de cet article.<\/p>\n<p style=\"text-align: justify;\">L&rsquo;acheteur, M. Reulet, est originaire de France. Il a \u00e9t\u00e9 embauch\u00e9 par l&rsquo;Universit\u00e9 de Sherbrooke pour y mener une recherche de haut niveau. D&rsquo;autre part, les vendeurs, M. Desch\u00eanes et Mme Llar\u00e9guy, vivent dans l\u2019immeuble depuis 1999 et sont en instance de divorce. Leur maison est sur le march\u00e9 depuis plus d\u2019un an.<\/p>\n<p style=\"text-align: justify;\">L&rsquo;acheteur, M. Reulet, alors qu\u2019il est de passage au pays, visite l\u2019immeuble pour la premi\u00e8re fois \u00e0 la mi-mars 2010. Les seules parties pr\u00e9sentes lors de cette visite furent M. Reulet, sa femme et l&rsquo;agent immobilier. Les vendeurs n\u2019\u00e9taient pas pr\u00e9sents et avaient oubli\u00e9 de d\u00e9verrouiller la porte qui donnait acc\u00e8s \u00e0 la piscine. Compte tenu du fait que M. Reulet devait d\u00e9buter ses nouvelles fonctions dans un d\u00e9lai assez court, il a d\u00e9montr\u00e9 un grand int\u00e9r\u00eat quant \u00e0 l\u2019acquisition de l\u2019immeuble.<\/p>\n<p style=\"text-align: justify;\">D\u00e8s leur retour en France, les acheteurs ont adress\u00e9 une liste de questions aux vendeurs. Ces questions ont \u00e9t\u00e9 donn\u00e9es \u00e0 l&rsquo;agent immobilier et transmises aux vendeurs. Par la suite, les vendeurs ont r\u00e9pondu \u00e0 celles-ci.<\/p>\n<p style=\"text-align: justify;\">La seconde visite a eu lieu le ou vers le 26 ou 27 avril 2010. La visite a dur\u00e9 plus longtemps que la premi\u00e8re et toute la famille \u00e9tait pr\u00e9sente et accompagn\u00e9e de l&rsquo;agent immobilier ainsi que d\u2019un entrepreneur en construction.<\/p>\n<p style=\"text-align: justify;\">Avant la visite, l&rsquo;agent immobilier avait poliment demand\u00e9 au vendeur de lui fournir la cl\u00e9 donnant acc\u00e8s \u00e0 la piscine, mais en vain. Suite \u00e0 cette visite, un rapport d&rsquo;inspection pr\u00e9achat a \u00e9t\u00e9 effectu\u00e9 et un nouveau document intitul\u00e9 \u00ab Modifications et avis de r\u00e9alisation de conditions \u00bb a \u00e9t\u00e9 r\u00e9dig\u00e9. Ce nouveau document indiquait que les vendeurs s\u2019engageaient, \u00e0 leurs propres frais, \u00e0 s\u2019assurer que toutes les fen\u00eatres puissent s\u2019ouvrir et se fermer correctement, \u00e0 r\u00e9parer le toit et \u00e0 nettoyer les goutti\u00e8res.<\/p>\n<p style=\"text-align: justify;\">L&rsquo;acte de vente a \u00e9t\u00e9 sign\u00e9 par les parties et l\u2019acheteur, M. Reulet, a pris possession de la maison en juillet 2010. C\u2019est avec une grande d\u00e9ception que les nouveaux propri\u00e9taires ont commenc\u00e9 \u00e0 constater des probl\u00e8mes critiques affectant la maison et constituant des vices cach\u00e9s.<\/p>\n<p style=\"text-align: justify;\">La piscine, \u00e0 laquelle ils n\u2019ont jamais eu acc\u00e8s \u00e9tait d\u00e9fectueuse. La toile \u00e9tait perfor\u00e9e, contrairement \u00e0 ce qu\u2019affirmaient les vendeurs dans la liste de questions envoy\u00e9e apr\u00e8s la premi\u00e8re visite. Par ailleurs, les fen\u00eatres ne s\u2019ouvraient pas correctement, la goutti\u00e8re n\u2019a pas \u00e9t\u00e9 nettoy\u00e9e et les acheteurs ont constat\u00e9s d\u2019autres probl\u00e8mes affectant l\u2019immeuble.<\/p>\n<p style=\"text-align: justify;\">Apr\u00e8s avoir effectu\u00e9 quelques r\u00e9parations d\u2019urgence, une lettre de mise en demeure a \u00e9t\u00e9 envoy\u00e9e aux vendeurs le 15 octobre pour les informer de l\u2019existence de vices cach\u00e9s non urgent. Le 22 Octobre, une lettre du procureur de Desch\u00eanes a \u00e9t\u00e9 envoy\u00e9e et des conversations t\u00e9l\u00e9phoniques ont eu lieu dans le but de r\u00e9soudre la situation. Tant dans la lettre du procureur que lors des appels, les vendeurs n\u2019ont d\u00e9montr\u00e9 aucune intention de visiter l\u2019immeuble, de proc\u00e9der \u00e0 une inspection de la maison \u00e0 l\u2019aide d\u2019un expert ni d\u2019entreprendre les r\u00e9parations n\u00e9cessaires.<\/p>\n<p style=\"text-align: justify;\">Le tribunal initial a conclu que les vendeurs \u00e9taient responsables de toutes les r\u00e9parations concernant les vices cach\u00e9s. Le vendeur a fait valoir que la d\u00e9nonciation \u00e9crite des vices cach\u00e9s ne lui a jamais \u00e9t\u00e9 envoy\u00e9e et qu\u2019il ne devrait pas \u00eatre tenu responsable des vices.<\/p>\n<p style=\"text-align: justify;\">La Cour d&rsquo;appel a confirm\u00e9 \u00e0 l&rsquo;unanimit\u00e9 le jugement de premi\u00e8re instance. Les juges de la Cour d&rsquo;appel ont convenu que le pr\u00e9avis requis concernant les r\u00e9parations urgentes n\u2019avait jamais \u00e9t\u00e9 donn\u00e9.
