ATTENTION ACHETEURS!"},"content":{"rendered":"<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\">Voici un cas o\u00f9 un vice apparent s\u2019est transform\u00e9 en un vice cach\u00e9\u00a0; le cas de <em>Jos\u00e9phine<\/em><em> Mackay c. St\u00e9phane Scalabrini, <\/em>2015 QCCS 39 (<a href=\"http:\/\/canlii.ca\/t\/gfxfg\">http:\/\/canlii.ca\/t\/gfxfg<\/a>).<\/p>\n<p style=\"text-align: justify;\">Dans le cas mentionn\u00e9 ci-dessus, le vendeur, St\u00e9phane Scalabrini, a achet\u00e9 un immeuble en mars 2009 afin de le r\u00e9parer et de le revendre. \u00c9tant tr\u00e8s habile de ses mains et \u00e9tant consid\u00e9r\u00e9 comme un homme \u00e0 tout faire exp\u00e9riment\u00e9, celui-ci a d\u00e9cid\u00e9 d&rsquo;entreprendre lui-m\u00eame toutes les r\u00e9novations int\u00e9rieures et ext\u00e9rieures n\u00e9cessaires. Il est important de mentionner que l\u2019immeuble avait d\u00e9j\u00e0 eu des probl\u00e8mes d&rsquo;infiltration d&rsquo;eau n\u00e9cessitant des r\u00e9parations. En installant tout simplement un syst\u00e8me de drainage, toutes infiltrations futures auraient pu \u00eatre pr\u00e9venues.<\/p>\n<p style=\"text-align: justify;\">Cependant, Scalabrini n&rsquo;a pas entrepris de telles r\u00e9parations. Le terrain sur lequel l\u2019immeuble \u00e9tait situ\u00e9 n\u2019\u00e9tait pas de niveau et des pilotis tr\u00e8s minces \u00e9taient utilis\u00e9s pour le soutenir. Le vendeur avait d\u00e9cid\u00e9 d\u2019effectuer des r\u00e9novations pour renforcer la fondation de l\u2019immeuble au lieu de simplement la remplacer.<\/p>\n<p style=\"text-align: justify;\">La nouvelle acheteuse, Jos\u00e9phine Mackay, a \u00e9t\u00e9 impressionn\u00e9e par l\u2019immeuble nouvellement et enti\u00e8rement r\u00e9nov\u00e9. Le vendeur, Scalabrini, a rassur\u00e9 l\u2019acheteuse \u00e0 propos de l\u2019immeuble et a en m\u00eame temps cach\u00e9 d\u2019importantes informations dans sa d\u00e9claration du vendeur, indiquant qu&rsquo;il n&rsquo;y avait jamais eu d&rsquo;infiltration d&rsquo;eau et qu\u2019une nouvelle fondation avait \u00e9t\u00e9 install\u00e9e.<\/p>\n<p style=\"text-align: justify;\">Satisfaite de l&rsquo;information ci-dessus et apr\u00e8s seulement deux heures et demie de visite, Mme Mackay a achet\u00e9 la maison en f\u00e9vrier 2012. Quelques semaines apr\u00e8s l&rsquo;achat, Mme Mackay a \u00e9t\u00e9 confront\u00e9e \u00e0 une premi\u00e8re s\u00e9rie d&rsquo;inondations au niveau du sous-sol.<\/p>\n<p style=\"text-align: justify;\">Le tribunal a jug\u00e9 que le vendeur devait \u00eatre tenu responsable de tous les dommages et tous les frais de r\u00e9novation que l&rsquo;acheteur a d\u00fb entreprendre afin de jouir de sa nouvelle maison. Pour les raisons suivantes la Cour a conclu que tous les signes visibles d&rsquo;un d\u00e9faut apparent sont devenus des vices cach\u00e9s en raison des actions du vendeur\u00a0:<\/p>\n<ol style=\"text-align: justify;\">\n<li>Le vendeur a falsifi\u00e9 sa d\u00e9claration du vendeur en affirmant qu\u2019il n\u2019y avait jamais eu de probl\u00e8me d\u2019infiltration d\u2019eau, qu\u2019il y avait une nouvelle fondation et qu\u2019il n\u2019avait pas de trace de moisissure ou de pourriture.<\/li>\n<\/ol>\n<ol style=\"text-align: justify;\" start=\"2\">\n<li>Bien que des signes d&rsquo;infiltration constituent un vice apparent, le fait que le vendeur ait enti\u00e8rement r\u00e9nov\u00e9 tout l\u2019int\u00e9rieur de l\u2019immeuble en masquant et en camouflant tous les signes, le vice apparent est donc devenu cach\u00e9.<\/li>\n<\/ol>\n<ol style=\"text-align: justify;\" start=\"3\">\n<li>Compte tenu des d\u00e9clarations du vendeur, l&rsquo;acheteur a satisfait \u00e0 son obligation de prudence et de diligence en effectuant une visite de 2.5 heures et n\u2019avait pas \u00e0 pousser plus loin son exploration car elle n\u2019avait pas \u00e0 soup\u00e7onner la mauvaise foi de son vendeur.<\/li>\n<\/ol>\n<p style=\"text-align: justify;\">Le tribunal a condamn\u00e9 le vendeur, Scalabrini, \u00e0 payer \u00e0 l&rsquo;acheteur, Mackay, la somme de 45 508,43$ repr\u00e9sentant les r\u00e9parations et les co\u00fbts n\u00e9cessaires ainsi que des dommages pour troubles et inconv\u00e9nients d&rsquo;un montant de 15,000.00 $, le tout pour un montant total de 60 508,43$.<\/p>\n<p style=\"text-align: justify;\">Par cons\u00e9quent, il est \u00e0 conclure que, face \u00e0 ce type de vice cach\u00e9, les tribunaux se prononcent selon la diligence de l&rsquo;acheteur et selon les informations qui lui ont \u00e9t\u00e9 donn\u00e9es en vue d&rsquo;\u00e9valuer la qualit\u00e9 de l\u2019immeuble. D&rsquo;autre part, le vendeur est tenu d&rsquo;agir de bonne foi et doit fournir, avec exactitude, toute l\u2019information qu\u2019il connait et qui pourrait \u00eatre utile \u00e0 l\u2019acheteur.<\/p>\n<p style=\"text-align: justify;\">Un vice apparent pourrait donc devenir un vice cach\u00e9 bas\u00e9 sur l\u2019attitude, les agissements et les renseignements fournis \u00e0 l&rsquo;acheteur par le vendeur pour le rassurer.<\/p>\n<p style=\"text-align: justify;\"><strong><u>ATTENTION VENDEURS!
