Par cons\u00e9quent, le locataire et le locateur ont le droit de s&rsquo;assurer que le logement est bien entretenu et habitable.<\/p>\n<p>L&rsquo;obligation du locateur de fournir au locataire la jouissance paisible du logement s&rsquo;\u00e9tend aux aires communes telles que les escaliers, la buanderie, le stationnement, les ascenseurs, le hall d&rsquo;entr\u00e9e, etc.<\/p>\n<p>Le locateur doit \u00e9galement garantir la s\u00e9curit\u00e9 des locataires et garantir l&rsquo;acc\u00e8s \u00e0 l&rsquo;immeuble sans aucun danger. De plus, le locateur doit garantir qu&rsquo;il n&rsquo;y a pas d&rsquo;infestation d&rsquo;insectes dans l\u2019immeuble et que les logements sont propres \u00e0 l&rsquo;habitation.<\/p>\n<p>L&rsquo;obligation du locateur d&rsquo;assurer la jouissance paisible du logement est une obligation de r\u00e9sultat. Ce qui signifie qu&rsquo;un locateur ne sera pas en mesure d&rsquo;invoquer son comportement raisonnable et diligent pour s&rsquo;exon\u00e9rer de toute responsabilit\u00e9.
