Elle est la contrepartie de la prestation de travail effectu\u00e9e par le salari\u00e9. La forme de la r\u00e9mun\u00e9ration et les modalit\u00e9s de son versement n\u2019importent pas pour d\u00e9terminer s\u2019il existe ou non un contrat de travail (art. 2087 du <em>Code civil du Qu\u00e9bec<\/em>). Toutefois, la r\u00e9mun\u00e9ration doit \u00eatre existante, sinon il s\u2019agit plut\u00f4t de b\u00e9n\u00e9volat, ce qui n\u2019est pas r\u00e9gi par les lois de travail.<\/p>\n<p>L\u2019employeur doit fournir le travail convenu au salari\u00e9 et lui permettre de l\u2019ex\u00e9cuter (art. 2087 du <em>Code civil du Qu\u00e9bec<\/em>). <strong>Il est clair que l\u2019employeur doit fournir une prestation de travail<\/strong>, le salari\u00e9 doit \u00eatre capable de travailler, c\u2019est-\u00e0-dire que le fait de suspendre (avec ou sans salaire) quelqu\u2019un sans motif organisationnel l\u00e9gitime est une violation du contrat.<\/p>\n<p>L\u2019employeur doit <strong>prot\u00e9ger la sant\u00e9, la s\u00e9curit\u00e9 et la dignit\u00e9 du salari\u00e9<\/strong> (art. 2087 du <em>Code civil du Qu\u00e9bec<\/em>). Une absence de travail peut \u00eatre une mesure qui touche \u00e0 sa dignit\u00e9.
