Les sanctions disponibles comprennent:<\/p>\n<ul>\n<li><strong><u>Une injonction<\/u><\/strong>: un tribunal peut ordonner \u00e0 un d\u00e9fendeur de cesser l&rsquo;action contest\u00e9e ou exiger l\u2019ex\u00e9cution sp\u00e9cifique d\u2019une obligation.<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a><\/li>\n<li><strong><u>Des dommages<\/u><\/strong>: les dommages-int\u00e9r\u00eats sont disponibles pour compenser ou r\u00e9parer un pr\u00e9judice subi par le demandeur qui r\u00e9sulte des actions ou omissions du d\u00e9fendeur.<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a> Les dommages peuvent \u00eatre ancr\u00e9s dans des obligations extracontractuelles ou contractuelles.<\/li>\n<li><strong><u>Une ordonnance de vendre une unit\u00e9<\/u><\/strong><u>.<\/u><a href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a><\/li>\n<li><a href=\"https:\/\/staging.schneiderlegal.com\/fr\/syndicate-of-co-owners-and-payment-of-the-common-expenses-and-registration-of-a-legal-hypothec\/\"><strong><u>L\u2019inscription d\u2019une hypoth\u00e8que l\u00e9gale<\/u><\/strong><\/a><\/li>\n<\/ul>\n<p>La d\u00e9claration de copropri\u00e9t\u00e9 peut aussi contenir des <u>clauses de p\u00e9nalit\u00e9s<\/u> en cas de manquement \u00e0 une obligation. <a href=\"#_ftn4\" name=\"_ftnref4\">[4]<\/a>\u00a0 La clause p\u00e9nale est un montant pr\u00e9d\u00e9termin\u00e9 souvent stipul\u00e9e dans la d\u00e9claration de copropri\u00e9t\u00e9 qui permet le syndicat des copropri\u00e9taires de r\u00e9cup\u00e9rer des dommages sans avoir \u00e0 recourir \u00e0 la discr\u00e9tion des tribunaux. Si la p\u00e9nalit\u00e9 est raisonnable, un copropri\u00e9taire fautif peut \u00eatre condamn\u00e9 \u00e0 payer la p\u00e9nalit\u00e9 pr\u00e9vue.<\/p>\n<p>Il convient \u00e9galement de noter que la \u00abth\u00e9orie des mains propres\u00bb s&rsquo;applique lorsque l&rsquo;on d\u00e9pose une plainte sur une base contractuelle devant le tribunal. Cette doctrine signifie que le demandeur doit venir devant les tribunaux avec les &laquo;&nbsp;mains propres&nbsp;&raquo; ou qu&rsquo;il n&rsquo;a rien \u00e0 se reprocher \u00e0 l&rsquo;\u00e9gard de la d\u00e9claration de copropri\u00e9t\u00e9. Par exemple, quelqu&rsquo;un qui poss\u00e8de un animal de compagnie en violation de la d\u00e9claration de copropri\u00e9t\u00e9 ne peut exiger une injonction de la cour contre son voisin qui poss\u00e8de \u00e9galement un animal de compagnie.<a href=\"#_ftn5\" name=\"_ftnref5\">[5]<\/a><\/p>\n<p>Il est \u00e9galement important de d\u00e9poser une plainte formelle dans le d\u00e9lai de prescription de trois (3) ans.<a href=\"#_ftn6\" name=\"_ftnref6\">[6]<\/a> Un d\u00e9faut de faire cela \u00e9quivaudrait \u00e0 une renonciation tacite \u00e0 l&rsquo;exercice de son droit et, dans certaines circonstances, il pourrait s&rsquo;agir d&rsquo;une validation tacite d&rsquo;une clause attaqu\u00e9e.<a href=\"#_ftn7\" name=\"_ftnref7\">[7]<\/a><\/p>\n<p><a href=\"#_ftnref1\" name=\"_ftn1\"><\/a><\/p>\n<p><a href=\"#_ftnref1\" name=\"_ftn1\"><\/a>[\/vc_column_text][mk_divider style=&nbsp;&raquo;shadow_line&nbsp;&raquo; margin_bottom=&nbsp;&raquo;50&Prime;][vc_column_text]<a href=\"#_ftnref1\" name=\"_ftn1\">[1]<\/a> <em>C.C.Q.<\/em> Art. 1080; Art. 1590.<\/p>\n<p><a href=\"#_ftnref2\" name=\"_ftn2\">[2]<\/a> <em>C.C.Q.<\/em> Art. 1458; Art. 1479; Art. 1607; Art. 1613.<\/p>\n<p><a href=\"#_ftnref3\" name=\"_ftn3\">[3]<\/a> <em>C.C.Q.<\/em> Art. 1080.<\/p>\n<p><a href=\"#_ftnref4\" name=\"_ftn4\">[4]<\/a> <em>C.C.Q.<\/em> Art. 1622.<\/p>\n<p><a href=\"#_ftnref5\" name=\"_ftn5\">[5]<\/a> <em>Rehmat c.
