Cependant, d\u2019importantes mesures administratives telles que la modification de la <a href=\"https:\/\/staging.schneiderlegal.com\/fr\/la-copropriete-divise\/la-destination-de-limmeuble\/\"><u>destination de l\u2019immeuble<\/u><\/a>\u00a0ou la modification du r\u00e8glement de l\u2019immeuble doivent \u00eatre soumises \u00e0 un vote, qu&rsquo;il soit <a href=\"https:\/\/staging.schneiderlegal.com\/fr\/la-copropriete-divise\/la-modification-tacite-de-la-declaration-de-copropriete\/\"><u>tacite ou explicite<\/u><\/a>.<\/p>\n<p>La nature de la proposition d\u00e9terminera quel m\u00e9canisme de vote est prescrit par la loi. Certaines d\u00e9cisions n\u00e9cessitent l&rsquo;obtention d&rsquo;une majorit\u00e9 du nombre de voix d\u00e9tenues par chaque copropri\u00e9taire en fonction de la valeur relative de sa fraction ou de son unit\u00e9.<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a> D&rsquo;autres d\u00e9cisions exigeront une majorit\u00e9 sp\u00e9ciale de 75%, 90% ou m\u00eame 100% des votes.<\/p>\n<p>Les quatre (4) m\u00e9canismes de votes sont les suivants:<\/p>\n<p style=\"padding-left: 30px;\">1) Le vote \u00e0 majorit\u00e9 simple (50% +1) ;<\/p>\n<p style=\"padding-left: 30px;\">2) La majorit\u00e9 des copropri\u00e9taires (50%+1), repr\u00e9sentant les trois quarts des voix de tous les copropri\u00e9taires ;<\/p>\n<p style=\"padding-left: 30px;\">3) La majorit\u00e9 des trois quarts des copropri\u00e9taires (75% +1), repr\u00e9sentant 90% des voix de tous les copropri\u00e9taires ; et<\/p>\n<p style=\"padding-left: 30px;\">4) Le vote unanime<\/p>\n<p><u>1) Le vote \u00e0 majorit\u00e9 simple<a href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a><\/u><\/p>\n<p>La plupart des d\u00e9cisions sont adopt\u00e9es par une majorit\u00e9 simple des voix des copropri\u00e9taires pr\u00e9sents ou repr\u00e9sent\u00e9s \u00e0 l&rsquo;assembl\u00e9e.<\/p>\n<p>Une majorit\u00e9 simple est requise pour:<\/p>\n<p style=\"padding-left: 30px;\">&#8211; L&rsquo;adoption ou la modification du r\u00e8glement de l\u2019immeuble;<\/p>\n<p style=\"padding-left: 30px;\">&#8211; L&rsquo;\u00e9lection des administrateurs; et<\/p>\n<p style=\"padding-left: 30px;\">&#8211; La correction d\u2019erreurs cl\u00e9ricales dans la d\u00e9claration de copropri\u00e9t\u00e9.<\/p>\n<p><u>2) La majorit\u00e9 des copropri\u00e9taires, repr\u00e9sentant les trois quarts des voix de tous les copropri\u00e9taires.<a href=\"#_ftn4\" name=\"_ftnref4\">[4]<\/a><\/u><\/p>\n<p>Le nombre de voix est d\u00e9termin\u00e9 en fonction de la valeur relative de la fraction d\u2019une copropri\u00e9t\u00e9 tenue par un copropri\u00e9taire.<a href=\"#_ftn5\" name=\"_ftnref5\">[5]<\/a> Par cons\u00e9quent, il est possible qu\u2019un copropri\u00e9taire d\u00e9tienne un pourcentage significatif des voix compar\u00e9 aux autres copropri\u00e9taires.<\/p>\n<p>Ce m\u00e9canisme de vote exige qu&rsquo;au moins 50% de tous les copropri\u00e9taires acceptent la proposition, et que cette majorit\u00e9 de copropri\u00e9taires d\u00e9tiennent au moins 75% des voix de tous les copropri\u00e9taires.<\/p>\n<p>Ces d\u00e9cisions portent notamment sur:<\/p>\n<ul>\n<li>Les actes d&rsquo;acquisition ou d&rsquo;ali\u00e9nation immobili\u00e8re par le syndicat des copropri\u00e9taires ;<\/li>\n<li>Les travaux de transformation, d\u2019agrandissement ou d\u2019am\u00e9lioration des parties communes, ainsi que la r\u00e9partition du co\u00fbt de ces travaux ;<\/li>\n<li>La construction de b\u00e2timents pour cr\u00e9er de nouvelles fractions ; et<\/li>\n<li>La modification de l&rsquo;acte constitutif de la copropri\u00e9t\u00e9 ou l\u2019\u00e9tat descriptif des fractions.<\/li>\n<\/ul>\n<p><u>3) La majorit\u00e9 des trois quarts des copropri\u00e9taires (75% + 1), repr\u00e9sentant au moins 90% des voix de tous les copropri\u00e9taires.<a href=\"#_ftn6\" name=\"_ftnref6\">[6]<\/a><\/u><\/p>\n<p>Les d\u00e9cisions qui sont assujetties \u00e0 ce m\u00e9canisme n\u00e9cessitent l&rsquo;approbation de 75% de tous les copropri\u00e9taires, qui d\u00e9tiennent au moins 90% des voix de tous les copropri\u00e9taires.<\/p>\n<p>Ces d\u00e9cisions comprennent:<\/p>\n<ul>\n<li>La modification de la <a href=\"https:\/\/staging.schneiderlegal.com\/fr\/la-copropriete-divise\/la-destination-de-limmeuble\/\"><u>destination de l\u2019immeuble<\/u><\/a>;<\/li>\n<li>Lorsqu&rsquo;e le syndicat des copropri\u00e9taires cherche \u00e0 modifier substantiellement une\/des parties de l\u2019immeuble, telles que l&rsquo;ali\u00e9nation des parties communes ; et<\/li>\n<li>La modification de <a href=\"https:\/\/staging.schneiderlegal.com\/fr\/la-copropriete-divise\/la-declaration-de-copropriete\/\"><u>la d\u00e9claration de copropri\u00e9t\u00e9<\/u><\/a>\u00a0pour permettre la d\u00e9tention d\u2019une fraction par plusieurs personnes ayant un droit de jouissance p\u00e9riodique et successif.<\/li>\n<\/ul>\n<p>Il convient de noter que certaines d\u00e9cisions relevant de l&rsquo;article 1097 <em>C.C.Q<\/em>, peut \u00e9galement relever de l&rsquo;article 1098 <em>C.C.Q<\/em> si ces d\u00e9cisions affectent la destination de l\u2019immeuble.<\/p>\n<p><u>4) Le vote unanime<\/u><\/p>\n<p>Un vote unanime \u00e0 l&rsquo;assembl\u00e9e des copropri\u00e9taires est requis lorsqu&rsquo;une proposition modifiant la valeur d&rsquo;une partie privative appartenant \u00e0 un\/une copropri\u00e9taire, ou une modification de la destination d&rsquo;une partie privative est propos\u00e9e. Ces d\u00e9cisions n\u00e9cessitent l&rsquo;unanimit\u00e9 car elles restreignent ou modifient essentiellement l&rsquo;utilisation d&rsquo;une unit\u00e9 privative, \u00e0 laquelle l&rsquo;approbation du copropri\u00e9taire en question est essentielle.<\/p>\n<p>En outre, si l&rsquo;application d&rsquo;une telle action influe sur d&rsquo;autres unit\u00e9s appartenant \u00e0 d&rsquo;autres copropri\u00e9taires, il\/elle doivent \u00e9galement donner leur approbation; Si elle implique une application g\u00e9n\u00e9rale affectant la valeur relative, la destination ou l&rsquo;utilisation d\u2019une ou plusieurs parties privatives, il faudrait un accord unanime. Le refus d&rsquo;une r\u00e9solution affectant la valeur d&rsquo;une partie privative par le copropri\u00e9taire rendra la proposition nulle.<a href=\"#_ftn7\" name=\"_ftnref7\">[7]<\/a><\/p>\n<p><a href=\"#_ftnref1\" name=\"_ftn1\"><\/a><\/p>\n<p><a href=\"#_ftnref1\" name=\"_ftn1\"><\/a>[\/vc_column_text][mk_divider style=&nbsp;&raquo;shadow_line&nbsp;&raquo; margin_bottom=&nbsp;&raquo;50&Prime;][vc_column_text]<a href=\"#_ftnref1\" name=\"_ftn1\">[1]<\/a> <em>Michelstein c.
