Dans la plupart des cas, les d\u00e9cisions sont adopt\u00e9es par le <a href=\"https:\/\/staging.schneiderlegal.com\/fr\/syndicate-of-co-owners-and-payment-of-the-common-expenses-and-registration-of-a-legal-hypothec\/\"><u>Syndicat<\/u><\/a>\u00a0\u00e0 <a href=\"https:\/\/staging.schneiderlegal.com\/fr\/la-copropriete-divise\/lassemblee-annuelle-des-coproprietaires\/\"><u>l&rsquo;assembl\u00e9e des copropri\u00e9taires<\/u><\/a>.<\/p>\n<p>Toutefois, le caract\u00e8re contractuel de la D\u00e9claration permet la possibilit\u00e9 de modification tacite si les r\u00e8gles de formation contractuelle ont \u00e9t\u00e9 respect\u00e9es.<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a> Le consentement des copropri\u00e9taires est n\u00e9cessaire pour modifier la D\u00e9claration, mais cela peut \u00eatre imput\u00e9 de la conduite, le silence ou l&rsquo;omission des copropri\u00e9taires.<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a><\/p>\n<p>Dans une d\u00e9cision de la Cour sup\u00e9rieure du Qu\u00e9bec en 2007,<a href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a> un demandeur a d\u00e9pos\u00e9 une plainte devant le tribunal selon laquelle son voisin d&rsquo;\u00e9tage avait remplac\u00e9 son rev\u00eatement de sol avec des panneaux de bois, ce qui a entra\u00een\u00e9 une diminution de l&rsquo;insonorisation. L&rsquo;installation de nouveau rev\u00eatement en bois \u00e9tait en contravention directe de la D\u00e9claration.<\/p>\n<p>G\u00e9n\u00e9ralement, un demandeur aurait des droits \u00e0 faire valoir contre le copropri\u00e9taire en violation de la D\u00e9claration et pourrait intenter un <a href=\"https:\/\/staging.schneiderlegal.com\/fr\/la-copropriete-divise\/les-sanctions-judiciaires\/\"><u>recours judiciaire<\/u><\/a>.<\/p>\n<p>Cependant, dans l\u2019affaire susmentionn\u00e9e, plus de 70% des copropri\u00e9taires avaient d\u00e9j\u00e0 remplac\u00e9 leur rev\u00eatement de sol en violation directe de la D\u00e9claration. Le tribunal a d\u00e9duit de la conduite de la majorit\u00e9 des copropri\u00e9taires qu&rsquo;ils avaient consenti \u00e0 une modification tacite de leur D\u00e9claration permettant l\u2019installation de panneaux de bois. La ratification d&rsquo;un acte interdit par le syndicat des copropri\u00e9taires peut aussi \u00eatre interpr\u00e9t\u00e9e comme une renonciation tacite \u00e0 l&rsquo;interdiction.<a href=\"#_ftn4\" name=\"_ftnref4\">[4]<\/a><\/p>\n<p><a href=\"#_ftnref1\" name=\"_ftn1\"><\/a>[\/vc_column_text][mk_divider style=&nbsp;&raquo;shadow_line&nbsp;&raquo; margin_bottom=&nbsp;&raquo;50&Prime;][vc_column_text]<a href=\"#_ftnref1\" name=\"_ftn1\">[1]<\/a> <em>Lemelin c.
