Ce document lie les parties entre elles, et les signataires doivent respecter leurs obligations et les droits des autres copropri\u00e9taires \u00e0 risque de <a href=\"https:\/\/staging.schneiderlegal.com\/fr\/la-copropriete-divise\/les-sanctions-judiciaires\/\"><u>sanctions judiciaires<\/u><\/a>\u00a0en cas de violation.<\/p>\n<p>Lors de la publication de la D\u00e9claration, la collectivit\u00e9 des copropri\u00e9taires constitue une personne morale prenant le nom de \u00abSyndicat\u00bb.<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a> Le but principal du Syndicat est la conservation de l&rsquo;immeuble, l\u2019entretien et l\u2019administration des parties communes, la sauvegarde des droits aff\u00e9rents \u00e0 l\u2019immeuble ou \u00e0 la copropri\u00e9t\u00e9, ainsi que toutes les op\u00e9rations d\u2019int\u00e9r\u00eat commun.<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a><\/p>\n<p><a href=\"https:\/\/staging.schneiderlegal.com\/fr\/la-copropriete-divise\/les-droits-et-obligations-du-syndicat-des-coproprietaires\/\"><u>Les droits et obligations du Syndicat<\/u><\/a>\u00a0sont \u00e9nonc\u00e9s dans la D\u00e9claration.<\/p>\n<p>La D\u00e9claration \u00e9tablit \u00e9galement le conseil d&rsquo;administration du Syndicat qui g\u00e9rera les t\u00e2ches administratives de l\u2019immeuble.<a href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a><\/p>\n<p>La D\u00e9claration est compos\u00e9e de trois parties.<a href=\"#_ftn4\" name=\"_ftnref4\">[4]<\/a><\/p>\n<p style=\"padding-left: 30px;\">1. L&rsquo;acte constitutif de copropri\u00e9t\u00e9, d\u00e9finissant la <a href=\"https:\/\/staging.schneiderlegal.com\/fr\/la-copropriete-divise\/la-destination-de-limmeuble\/\"><u>destination de l\u2019immeuble<\/u><\/a>, des <u><a href=\"https:\/\/staging.schneiderlegal.com\/fr\/la-copropriete-divise\/\">parties privatives <\/a><\/u>\u00a0et des <a href=\"https:\/\/staging.schneiderlegal.com\/fr\/la-copropriete-divise\/\"><u>parties communes<\/u><\/a>. Il d\u00e9termine \u00e9galement\u00a0:<a href=\"#_ftn5\" name=\"_ftnref5\">[5]\n<\/a><br \/>\nA) La valeur relative de chaque fraction, et la m\u00e9thode suivie pour l\u2019\u00e9tablir;<\/p>\n<p style=\"padding-left: 30px;\">B) La contribution aux <a href=\"https:\/\/staging.schneiderlegal.com\/fr\/la-copropriete-divise\/\"><u>charges communes<\/u><\/a>;<\/p>\n<p style=\"padding-left: 30px;\">C) Le nombre de\u00a0<a href=\"https:\/\/staging.schneiderlegal.com\/fr\/la-copropriete-divise\/le-processus-de-prise-de-decision\/\"><u>voix<\/u><\/a>\u00a0attach\u00e9s \u00e0 chaque fraction;<\/p>\n<p style=\"padding-left: 30px;\">D) <a href=\"https:\/\/staging.schneiderlegal.com\/fr\/la-copropriete-divise\/les-droits-et-obligations-du-syndicat-des-coproprietaires\/\"><u>Les pouvoirs et devoirs respectifs du conseil d\u2019administration du Syndicat<\/u><\/a> et de l\u2019assembl\u00e9e des copropri\u00e9taires; et<\/p>\n<p style=\"padding-left: 30px;\">E) Toute autre convention relative \u00e0 l\u2019immeuble ou \u00e0 ses parties privatives ou communes.<\/p>\n<p>&nbsp;<\/p>\n<ol start=\"2\">\n<li>Le r\u00e8glement de l\u2019immeuble, contenant les r\u00e8gles relatives \u00e0:<a href=\"#_ftn6\" name=\"_ftnref6\">[6]<\/a><\/li>\n<\/ol>\n<p style=\"padding-left: 30px;\">A) La jouissance paisible;<\/p>\n<p style=\"padding-left: 30px;\">B) L\u2019usage et l\u2019entretien des parties privatives et communes;<\/p>\n<p style=\"padding-left: 30px;\">C) Le fonctionnement et \u00e0 l\u2019administration de la copropri\u00e9t\u00e9; et<\/p>\n<p style=\"padding-left: 30px;\">D) La proc\u00e9dure de cotisation et de recouvrement des contributions aux <u><a href=\"https:\/\/staging.schneiderlegal.com\/fr\/la-copropriete-divise\/\">charges communes<\/a>.<\/u><\/p>\n<p>&nbsp;<\/p>\n<ol start=\"3\">\n<li>L\u2019\u00e9tat descriptif des fractions, lequel contient\u00a0:<a href=\"#_ftn7\" name=\"_ftnref7\">[7]<\/a><\/li>\n<\/ol>\n<p style=\"padding-left: 30px;\">A) La d\u00e9signation cadastrale des parties privatives et des parties communes de l\u2019immeuble;<\/p>\n<p style=\"padding-left: 30px;\">B) L\u2019attribution des portions priv\u00e9es et communes; et<\/p>\n<p style=\"padding-left: 30px;\">C) La description des droits r\u00e9els grevant l\u2019immeuble ou existant en sa faveur, sauf les hypoth\u00e8ques et les suret\u00e9s additionnelles qui s\u2019y greffent.<\/p>\n<p>&nbsp;<\/p>\n<p>La D\u00e9claration divise donc la propri\u00e9t\u00e9 de l\u2019immeuble en fractions distinctes, tout en d\u00e9crivant les droits et les obligations des copropri\u00e9taires concernant les r\u00e8gles de jouissance, d&rsquo;utilisation et de maintenance de l\u2019immeuble, ainsi que les r\u00e8gles relatives \u00e0 la bonne administration de la copropri\u00e9t\u00e9.<a href=\"#_ftn8\" name=\"_ftnref8\">[8]<\/a><\/p>\n<p>Le caract\u00e8re contractuel de la D\u00e9claration comporte toutes les r\u00e8gles de la formation et de l&rsquo;interpr\u00e9tation des contrats.<a href=\"#_ftn9\" name=\"_ftnref9\">[9]<\/a> Le droit des contrats vise \u00e0 prot\u00e9ger les attentes raisonnables des parties. Tout copropri\u00e9taire \u00e9ventuel doit donc \u00eatre inform\u00e9 de tous les termes inhabituels \u00e9nonc\u00e9s dans la D\u00e9claration.<a href=\"#_ftn10\" name=\"_ftnref10\">[10]<\/a><\/p>\n<p>Toute modification future de la D\u00e9claration n\u00e9cessitera une forme de consentement par les copropri\u00e9taires assujettis, souvent exprim\u00e9 \u00e0 travers le <a href=\"https:\/\/staging.schneiderlegal.com\/fr\/la-copropriete-divise\/la-modification-tacite-de-la-declaration-de-copropriete\/\"><u>droit de vote, qu&rsquo;ils soient explicites ou tacites<\/u><\/a>.<a href=\"#_ftn11\" name=\"_ftnref11\">[11]<\/a><\/p>\n<p>La possibilit\u00e9 de n\u00e9gocier les termes du contrat d\u00e9terminera si la D\u00e9claration peut \u00eatre cat\u00e9goris\u00e9e comme un contrat d&rsquo;adh\u00e9sion.<a href=\"#_ftn12\" name=\"_ftnref12\">[12]<\/a> Le <em>Code Civil du Qu\u00e9bec<\/em> offre plus de protection aux parties qui n&rsquo;ont pas eu la chance de n\u00e9gocier les termes de leur contrat envers des clauses pouvant \u00eatre interpr\u00e9t\u00e9s comme \u00e9tant abusives, ambigu\u00ebs ou externes.
