Elle permet d\u2019emp\u00eacher le propri\u00e9taire d\u2019un immeuble de vendre sa propri\u00e9t\u00e9 sans vans vous payer pour vos services de r\u00e9novation ou de construction.<\/p>\n<p style=\"text-align: justify;\">L\u2019entrepreneur, le sous-entrepreneur, l\u2019ouvrier, le fournisseur de mat\u00e9riaux, l\u2019ing\u00e9nieur et l\u2019architecte peuvent b\u00e9n\u00e9ficier d\u2019une hypoth\u00e8que l\u00e9gale de la construction.<\/p>\n<p style=\"text-align: justify;\">L\u2019hypoth\u00e8que l\u00e9gale de la construction existe en faveur de son b\u00e9n\u00e9ficiaire d\u00e8s que celui-ci d\u00e9tient une cr\u00e9ance contre le propri\u00e9taire d\u2019un immeuble pour les travaux ci-dessous\u00a0:<\/p>\n<ul style=\"text-align: justify;\">\n<li>Travaux de construction, d\u2019agrandissement ou de r\u00e9novation de l\u2019immeuble;<\/li>\n<\/ul>\n<ul style=\"text-align: justify;\">\n<li>Fourniture des mat\u00e9riaux pour effectuer ces travaux;<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Les travaux non vis\u00e9s par une hypoth\u00e8que l\u00e9gale de la construction sont, par exemple, la d\u00e9contamination du sol ou les simples travaux d\u2019entretien.<\/p>\n<p style=\"text-align: justify;\">Les immeubles appartenant \u00e0 Hydro-Qu\u00e9bec, au domaine public, aux municipalit\u00e9s, les prisons, les stations de m\u00e9tro, les \u00e9coles et les Cegeps et les biblioth\u00e8ques ne peuvent faire l\u2019objet d\u2019une hypoth\u00e8que l\u00e9gale de la construction.<\/p>\n<p style=\"text-align: justify;\">Il y a une pr\u00e9somption que tous les travaux apportent une plus-value de l\u2019immeuble.<\/p>\n<p style=\"text-align: justify;\"><strong><u>D\u00c9LAIS\u00a0:<\/u><\/strong><\/p>\n<p style=\"text-align: justify;\">Vous disposez de 30 jours \u00e0 partir de la fin des travaux de r\u00e9novation\/construction pour inscrire une hypoth\u00e8que l\u00e9gale de la construction.<\/p>\n<p style=\"text-align: justify;\"><strong><u>D\u00c9NONCIATION\u00a0:<\/u><\/strong><\/p>\n<p style=\"text-align: justify;\">Dans le cas o\u00f9 vous \u00eates un travailleur qui n\u2019a pas directement fait affaire avec le propri\u00e9taire, il est n\u00e9cessaire, pour qu\u2019une hypoth\u00e8que l\u00e9gale puisse prendre naissance en votre faveur, de d\u00e9noncer, par \u00e9crit, votre contrat au propri\u00e9taire.<\/p>\n<p style=\"text-align: justify;\">Cette d\u00e9nonciation doit \u00eatre faite par \u00e9crit avec preuve de signification avant le d\u00e9but des travaux en incluant.<\/p>\n<p style=\"text-align: justify;\"><strong><u>PR\u00c9AVIS D\u2019EXERCICE D\u2019UN RECOURS HYPOTH\u00c9CAIRE<\/u><\/strong><\/p>\n<p style=\"text-align: justify;\">Le pr\u00e9avis d\u2019exercice d\u2019un recours hypoth\u00e9caire constitue l\u2019\u00e9tape suivante. Celle-ci permettra l\u2019exercice des recours hypoth\u00e9caires et doit \u00eatre publi\u00e9e dans les six (6) mois de la fin des travaux, sans quoi l\u2019hypoth\u00e8que l\u00e9gale s\u2019\u00e9teint.<\/p>\n<p style=\"text-align: justify;\"><strong><u>RECOURS HYPOTH\u00c9CAIRES\u00a0:<\/u><\/strong><\/p>\n<p style=\"text-align: justify;\">Voici les quatre (4) recours pour tout cr\u00e9ancier hypoth\u00e9caire qui souhaite r\u00e9clamer sa cr\u00e9ance\u00a0:<\/p>\n<p style=\"padding-left: 30px; text-align: justify;\">i. Prise de possession<br \/>\nii. Prise en paiement<br \/>\niii. Vente par le cr\u00e9ancier<br \/>\niv. Vente sous contr\u00f4le de la justice<\/p>\n<p style=\"text-align: justify;\"><strong><u>RADIATION D\u2019UNE HYPOTH\u00c8QUE L\u00c9GALE:<\/u><\/strong><\/p>\n<p style=\"text-align: justify;\">Si l\u2019une des conditions n\u00e9cessaire \u00e0 l\u2019ouverture d\u2019une hypoth\u00e8que l\u00e9gale n\u2019est pas remplie, il est possible d\u2019effectuer une demande afin de faire radier celle-ci.<\/p>\n<p style=\"text-align: justify;\">Par exemple, si un contracteur a effectu\u00e9 des travaux sans permis valide et inscrit par la suite une hypoth\u00e8que l\u00e9gale, le propri\u00e9taire peut exiger la radiation de celle-ci. Il en est de m\u00eame s\u2019il ne poss\u00e9dait pas un tel permis lors de l\u2019inscription de l\u2019hypoth\u00e8que seulement.<\/p>\n<p style=\"text-align: justify;\">Par ailleurs, lorsqu\u2019une telle hypoth\u00e8que est inscrite et valide, il est toujours possible de n\u00e9gocier \u00e0 l\u2019amiable la radiation de celle-ci. On peut, par exemple, prendre une entente de paiement \u00e9chelonn\u00e9e avec le contractant cr\u00e9ancier ou encore payer une partie ou la totalit\u00e9 de la cr\u00e9ance en l\u2019\u00e9change de la radiation de l\u2019hypoth\u00e8que l\u00e9gale.<\/p>\n<p style=\"text-align: justify;\">Finalement, une hypoth\u00e8que l\u00e9gale inscrite apr\u00e8s 30 jours suivant la fin des travaux est invalide.
