Ayant divulgu\u00e9 de bonne foi les informations qu\u2019il avait, on ne saurait alors lui reprocher une faute quelconque.<\/p>\n<p style=\"text-align: justify;\">Cette exception est \u00e9dict\u00e9e par l\u2019alin\u00e9a 2 de l\u2019article 1733 du <em>Code civil du Qu\u00e9bec<\/em>. Il y est \u00e9galement pr\u00e9vu qu\u2019un vendeur non professionnel peut exclure de la vente la garantie de qualit\u00e9 l\u00e9gale, \u00e9vitant ainsi d\u2019\u00eatre tenu responsable.<\/p>\n<p style=\"text-align: justify;\">Cette exclusion est commune en mati\u00e8re successorale\u00a0: le liquidateur ou les h\u00e9ritiers cherchent g\u00e9n\u00e9ralement \u00e0 vendre l\u2019immeuble du\/de la d\u00e9funt\/e sans garantie l\u00e9gale puisqu\u2019ils n\u2019ont pas habit\u00e9 celui-ci et n\u2019ont pas n\u00e9cessairement connaissance de son \u00e9tat.<\/p>\n<p style=\"text-align: justify;\">Un immeuble vendu sans garantie l\u00e9gale contient g\u00e9n\u00e9ralement une clause contenant une phrase ressemblant \u00e0 celle-ci\u00a0:<\/p>\n<p><a href=\"#_ftnref1\" name=\"_ftn1\"><\/a>[\/vc_column_text][mk_blockquote style=&nbsp;&raquo;line-style&nbsp;&raquo; font_family=&nbsp;&raquo;none&nbsp;&raquo;]<em>L\u2019acte de vente ou l\u2019immeuble est vendu sans garantie l\u00e9gale aux risques et p\u00e9rils de l\u2019acheteur<\/em>[\/mk_blockquote][vc_column_text]<a href=\"#_ftn1\" name=\"_ftnref1\"><\/a><\/p>\n<p style=\"text-align: justify;\">Un acheteur qui intente des proc\u00e9dures judiciaires contre un vendeur alors que l\u2019immeuble a \u00e9t\u00e9 vendu sans garantie l\u00e9gale, \u00e0 ses risques et p\u00e9rils, doit prouver que le vendeur a eu un comportement dolosif et que les fausses repr\u00e9sentations du vendeur constituent une faute intentionnelle, une faute grossi\u00e8re ou une n\u00e9gligence grossi\u00e8re suivant l\u2019article 1474 C.c.Q<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a>.<\/p>\n<p><a href=\"#_ftn1\" name=\"_ftnref1\"><\/a><\/p>\n<p><a href=\"#_ftnref1\" name=\"_ftn1\"><\/a><\/p>\n<p><a href=\"#_ftnref1\" name=\"_ftn1\"><\/a>[\/vc_column_text][mk_divider style=&nbsp;&raquo;thin_solid&nbsp;&raquo; divider_width=&nbsp;&raquo;one_third&nbsp;&raquo; align=&nbsp;&raquo;left&nbsp;&raquo; thickness=&nbsp;&raquo;2&Prime; margin_bottom=&nbsp;&raquo;50&Prime;][vc_column_text]<a href=\"#_ftnref1\" name=\"_ftn1\">[1]<\/a> Th\u00e9berge c.
